Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Muster platform, including musterhq.com, muster.ca, and any associated applications or services (collectively, the "Platform"), operated by Muster ("we," "our," or "us").
By creating an account or using the Platform, you agree to these Terms. If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You must be at least 16 years of age to create an account. Users under 18 must have the consent of a parent or guardian, or be enrolled through an authorized educational or employer account. By using the Platform, you represent that you meet these requirements.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@musterhq.com if you suspect unauthorized access.
Organization administrators are responsible for managing member access, roles, and permissions within their workspace. Muster is not liable for actions taken by members within an organization's workspace.
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable regulation.
- Submit false, misleading, or fraudulent safety data, incident reports, or training records.
- Attempt to gain unauthorized access to any part of the Platform or another user's account.
- Interfere with or disrupt the integrity or performance of the Platform.
- Reverse engineer, decompile, or attempt to extract source code from the Platform.
- Resell or sublicense access to the Platform without our written consent.
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
Muster provides tools to help organizations manage safety records and compliance workflows. The Platform does not guarantee regulatory compliance and is not a substitute for professional legal, safety, or engineering advice. Organizations are solely responsible for ensuring their safety programs meet applicable regulatory requirements (including WCB, OHS, and applicable provincial legislation).
Paid subscriptions are billed in advance on a monthly or annual basis. All fees are in Canadian dollars unless otherwise stated. Subscriptions automatically renew unless cancelled before the renewal date. Refunds are not provided for partial periods except as required by applicable consumer protection law. We reserve the right to modify pricing with 30 days' written notice to active subscribers.
You retain ownership of all data you submit to the Platform. By submitting data, you grant Muster a limited, non-exclusive license to store, process, and display that data solely for the purpose of providing the Platform to you. We do not sell your data or use it to train AI models. See our Privacy Policy and Data Processing Agreement for details.
The Muster name, logo, platform design, and all associated intellectual property are owned by Muster. Nothing in these Terms grants you a license to use our intellectual property beyond what is necessary to use the Platform as intended.
To the maximum extent permitted by applicable law, Muster's total liability for any claim arising from your use of the Platform is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including loss of data, business interruption, or personal injury arising from reliance on the Platform.
Nothing in these Terms limits liability for fraud, willful misconduct, or as otherwise required by Canadian law.
You may cancel your account at any time through your account settings. We may suspend or terminate your account for material breach of these Terms, with or without notice depending on the severity of the breach. Upon termination, your access to the Platform will cease. Data will be retained and deleted in accordance with our Privacy Policy.
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any dispute arising from these Terms or your use of the Platform shall be resolved by the courts of Alberta, and you consent to the exclusive jurisdiction of those courts. If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
We may update these Terms from time to time. Material changes will be communicated by email to registered users at least 14 days before taking effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
